What To Do If You Are In A Truck Accident
- Report the accident to your insurance company. You DO NOT have to tell them anything that is not in your accident report.
- Take photographs of your injuries and the damage to your vehicle. The more photos you have, the better.
- DO NOT talk to other insurance companies or the trucking company’s claims adjuster. DO NOT sign anything they ask you to. If you have retained a lawyer, give the insurance company their contact information. If you have not, tell the insurance company that you are in the process of retaining a lawyer.
- See a doctor as soon as possible to receive a comprehensive evaluation. Document your injuries.
- Ensure that your police report is filed. You can also file this yourself. (See information box
Crash Report Information
Under Texas law, you must file a Crash Report, Form CR2, when an accident results in:
- injury or death
- vehicle or property damage of over $1000
Usually, the officer on the scene will file this report. If he or she does not, you must file it yourself within 10 days of your accident.
